Participation constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules. The “Color of Love” Sweepstakes begins at 12:00:01 a.m., Eastern Daylight Time (“EDT”) on February 1, 2010 and ends at 11:59:59 p.m., EDT on February 28, 2010 ("Sweepstakes Period"). Sweepstakes is sponsored by L&M Companies, Inc., 2925 Huntleigh Drive, Raleigh, NC 27604 (the "Sponsor"), who is solely responsible for all aspects of this Sweepstakes.
Eligibility: The Sweepstakes is open to all legal residents of the United States, D.C., and Canada (the “Locations”), except in the province of Quebec, where it is void, and wherever else prohibited or restricted by law. Participants must be at least 18 years of age by the February 1, 2010. Also, participants must be valid purchasers of wholesale produce who make orders of at least 25,000 pounds of apples per year. This promotion is not open to the general public. Employees, officers, directors and representatives of Sponsor and Administrator (see below), its parent company, affiliates, subsidiaries, licensees, service providers, advertising and promotion agencies, those involved in the production, development, implementation or handling of the Sweepstakes, any agents acting on behalf of the above entities, as well as the immediate family members (parents, children, siblings, spouses) and/or persons living in the same household (whether related or not) of each are not eligible to participate in the Sweepstakes. All federal, state and local laws and regulations apply. Void where prohibited, taxed or otherwise restricted by law.
Two Ways to Enter:
1.) Eligible participants can receive one (1) valid Sweepstakes entry for every 1,000 cases (40 lb. cases or equivalent) of apples and pears purchased from the Sponsor during the Sweepstakes Period.
2.) Enter by hand printing on a 3" x 5" card, in black or blue ink, your first name, last name, email address (if available), mailing address, city, state, zip, phone number with area code first, date of birth and mail the 3" x 5" card in a first class stamped envelope to: “Color of Love” Sweepstakes c/o 90 Rockwood Place, Rochester, NY 14610. The mail-in entries must be postmarked by February 28, 2010, and received by March 4, 2010. Each properly completed and received card will receive one (1) entry into the Sweepstakes drawing. Limit one mail-in entry per envelope per person. Typed, computer generated, or otherwise mechanically reproduced 3” x 5” cards, and outer envelopes are NOT allowed and will not be accepted. All entries become the exclusive property of Sponsor and will not be acknowledged or returned.
Prizes: One (1) Grand Prize winner will receive a trip for two (2) people to Maui, Hawaii. The prize package includes roundtrip economy airfare and 6days/5nights hotel accommodations and $500 cash for expenses. Seats are subject to availability at the time of booking. Blackout dates may apply. Tickets are non-transferable. Tickets do not earn frequent flyer mileage credit or points in any program. The prize winner’s ticket may not be used to qualify for any promotional offer. Passengers are required to pay any applicable ticket and/or airport taxes that may be required at the time of ticket issuance. Travel will originate from the airport closest to the Grand Prize winners residence or at the Sponsors’ sole discretion. Taxes will be advised at time of booking. All travel must be completed by November 15, 2010. Travel and hotel accommodations are subject to capacity controls, availability, blackout dates and other restrictions, all of which are subject to change at the Sponsor’s sole discretion. The Grand Prize winner will be solely responsible for all other expenses not specifically set forth herein including but not limited to transportation, travel insurance (which is strongly recommended), taxes, meals, transfers, gratuities, souvenirs, fuel surcharges, port charges, and any other incidentals. The Grand Prize package has an Approximate Retail Value (“ARV”) of $4,500. The Sponsor is also offering a 75% cash option of $3,375 cash as an alternate prize paid directly to the purchasing company. The Sponsor reserves the right at their sole discretion to substitute the prize with another prize of equal or greater value in the event that any aforementioned prize is not available. All decisions by the Sponsor as to prize winner and prizes are final.
Prize Conditions: The Grand Prize winner is solely responsible for all applicable federal, state and local taxes and/or any other fees/costs associated with the prize or delivery or receipt of the prize. The winner and his/her travel companion will be required to sign and return to the Sponsor an Affidavit of Eligibility, Acceptance of the Official Rules and Liability / Publicity Release (unless prohibited) within 14 days of written notification or prize winner will be disqualified. If travel companion is a minor (under applicable state or provincial law), travel companion’s parent or legal guardian must sign and return all required documentation and accompany minor on trip. In the event of noncompliance with the Official Rules, if a winner cannot be reached at the address/phone number on winner’s entry within 5 days of the first attempt, or if the prize or prize notification is returned as unclaimed or undeliverable, an alternate winner will be selected. The prize will be only awarded to a verified winner. The winner’s entry into the Sweepstakes and acceptance of the prize constitutes permission (except where prohibited by law) for the Sponsor to use said winner’s name, photograph, likeness, statements, biographical information, voice and address (city and state) and/or prize information, without limitation, for promotional purposes, in all forms of media, in perpetuity, without notice or further compensation. Prizes are not transferable. No substitutions or exchanges (including for cash) of any prizes will be permitted, except that the Sponsor reserve the right at their sole discretion to substitute the prize with another prize of equal or greater value.
Terms & Conditions:
This Sweepstakes is subject to all applicable federal, state, and local laws. By entering the Sweepstakes, entrants agree to release, discharge, indemnify and hold harmless the Sponsor and its parent company, subsidiaries, affiliates, retailers, distributors and advertising and promotion agencies, and prize suppliers, and each of their respective directors, officers, employees, shareholders and agents from any and all liability, loss, damage or injuries to any person (including death) or property of any kind sustained in connection with their participation in the Sweepstakes or from their acceptance, receipt, possession and/or use or misuse of the prize, or for any typographical or other error in the printing, offering or announcement of the prize. Entrants further acknowledge that said parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee express or implied, in fact or in law, relative to the prize, including, but not limited to, its quality or fitness for a particular purpose. Any person attempting to defraud or in any way tamper with the Sweepstakes mechanics and/or implementation will be prosecuted to the fullest extent of the law. By participating, entrants agree to be bound by these Official Rules and the decisions of the Sweepstakes Administrator, and waive any right to claim ambiguity in the Sweepstakes or these Official Rules. Sponsor reserves the right to disqualify any entrant that Sponsor determines, in its sole discretion, violates these Official Rules. This Sweepstakes is void where prohibited.
Drawing and Notification:
The Grand Prize winner will be selected, from among all eligible entries received, in a random drawing on or about March 17, 2010, by American Sweepstakes & Promotion Co. (“the Administrator”) an independent judging organization, whose decisions are final and binding in all matters relating to this Sweepstakes. Odds of winning will depend on the total number of eligible entries received. The Grand Prize winner will be contacted by telephone and will receive a USPS mail package of prize confirmation.
